3.1 Illegal or Harmful Content

  • Hosting or distributing material that is illegal, infringing, defamatory, obscene, or promotes violence.
  • Child exploitation, hate speech, terrorist content, or any material prohibited by local or international law.

3.2 Spam, Phishing, Malware

  • Sending unsolicited bulk email (spam).
  • Creating phishing campaigns, malicious sites or software.
  • Using email/mail services to mine or harvest email addresses.

3.3 Network Abuse

  • Launching Distributed Denial of Service (DDoS) attacks.
  • Port scanning, probing, brute force, or attempts to penetrate networks or systems.
  • Excessive bandwidth or CPU consumption that degrades service for others.

3.4 Copyright and Trademark Infringement

  • Hosting copyrighted material without proper authorization.
  • Violating digital rights management protections.
  • Misusing trademarks to mislead or confuse users.

3.5 Unauthorized System Access

  • Using account credentials that are not assigned to you.
  • Attempting to access another client’s files or systems.

3.6 Financial Fraud and Illicit Behavior

  • Hosting phishing pages or fake banking/login portals.
  • Engaging in credit card fraud or payment abuse.
  • Conducting illegal sales or distribution of regulated goods or services.

3.7 Privacy Violations

  • Collecting personal data without consent or authorization.
  • Publishing private content such as personal information, credentials, or private communications.

4. Permitted Use

Clients are encouraged to use JAMILATECH Ltd. services in a lawful, ethical manner:

  • Hosting website content, blogs, e-commerce stores, forums, APIs, and custom applications in compliance with applicable laws.
  • Using email services for legitimate business or personal communication.
  • Backing up data, managing DNS, registering domains, and other standard hosting activities.
  • Hosting open-source or custom-built software, provided it does not violate this AUP.

5. Responsibilities

5.1 Client Responsibilities

Clients must:

  • Ensure content and activities comply with applicable laws and this AUP.
  • Secure account credentials and use strong passwords/2FA.
  • Monitor resource usage and scale resources appropriately.
  • Maintain regular backups of content via JAMILATECH Ltd.’s policies or client-managed backups.
  • Report security incidents, breaches, or suspicious activity.

5.2 JAMILATECH Ltd. Responsibilities

We commit to:

  • Providing clear documentation, alerts, and support around AUP compliance.
  • Monitoring infrastructure for signs of abuse or illicit activity.
  • Promptly investigating reports of policy violations.
  • Taking enforceable actions, such as throttling, suspension, or termination as necessary.
  • Respecting client privacy and providing fair warning before enforcement, except in emergencies.

6. Enforcement and Remedies

6.1 Investigations

Upon notification or detection of a violation, JAMILATECH Ltd. will investigate promptly and confidentially.

6.2 Enforcement Actions

  • Warning: Minor or first-time violations may receive written warning.
  • Throttling/Suspension: Partial service suspension to prevent further abuse.
  • Account Termination: Severe or repeated violations may result in full termination.

6.3 Appeals

Clients may appeal enforcement decisions by contacting JAMILATECH Ltd. support at support@mediabirdco.net. Appeals will be reviewed objectively and resolved promptly.

7. Disclaimers

JAMILATECH Ltd. provides these services and policies on an “as-is” basis. We disclaim liability for:

  • Loss or damage resulting from legitimate enforcement actions.
  • Third-party content or activities hosted on our infrastructure.
  • Downtime or outages resulting from investigations or remediation.

We are not liable for client actions that violate this AUP or legal regulations.

8. Policy Modifications

JAMILATECH Ltd. may update this AUP periodically to reflect evolving legal, technical, or operational standards. Revised versions will be posted at mediabirdco.net/acceptable-use-policy and emailed to customers. Continued use of services after such updates implies acceptance.
